Privacy Policy

The purpose of this Privacy Policy is to facilitate and make available to Users all the information regarding the processing of their personal data resulting from the use of the website. https://angelpiqueras.com (hereinafter "the Website") in accordance with the provisions of the General Data Protection Regulation 679/2016 (hereinafter "GDPR") and the Organic Law on Personal Data Protection and Guarantee of Digital Rights 3/2018 (hereinafter "LOPDGDD").

1. Who is the Data Controller?

In accordance with Article 13 of the RGPD, we inform you that the person responsible for the processing of personal data on the Web is Isabel Garcia Lopez with VAT number 20436478 N (hereinafter "AP 18 OFFICIAL" or the "Responsible" indistinctly).

2. What are the purposes of data processing?

The Responsible will be able to access and process the data provided by the User directly through the contact and subscription forms of the Website. The Responsible may also have access to certain User data resulting from browsing the Web due to the installation of cookies, more information about it in the Cookies Policy.

By way of example, the data to which the Data Controller may have access are:

  • Identification data: name, surname, address, user name, etc.
  • Data related to subscription/registration: bank account number, date of birth, gender, etc.
  • Data related to the query/message raised in the contact form.

The Data Controller will process the data for the following purposes:

  • Manage and formalize the registration in the form in the "Contact" section.
  • Formalize, execute and manage purchases in the store.
  • Respond and respond to requests and inquiries that the User may make by any means of contact with the Responsible.

The basis of legitimacy of the processing of data by the Data Controller is the express and informed consent of the User in each case, as well as the execution of the contract and compliance with the legal obligations arising therefrom.

How does the sending of information through our Newsletter work?

In the event that the User has authorized, by ticking the relevant box on the forms, the subscription to the Newsletter, AP 18 OFFICIAL will send him/her information about its activities, news, etc. 

Users registered for the Newsletter may revoke their consent to receive communications at any time, through the link or button provided for this purpose in each of the communications, or by communicating their desire to revoke their consent through the following channels:

4. Who are the recipients of the data?

AP18 OFFICIAL FANS CLUB is the main recipient of the Users' personal data. In no case the data will be processed for its own purposes.

The personal data obtained from the User will not be sold, rented, transferred or made available to third parties, except to those AP 18 OFFICIAL service providers that require access to the data to provide their services. In any case, such access will be made with the relevant legal guarantees and in no case, the data will be processed for the purposes of such suppliers.

5. What is the duration of data processing and storage period?

The Responsible will process the personal data of the Users as long as they are necessary for the service and/or until the User requests their deletion. 

In any case, and even if the User requests the deletion of his data, AP 18 OFFICIAL may keep them and maintain them, under proper blocking, for the period necessary to comply with its legal obligations and to make them available to the authorities with jurisdiction in the various matters that may apply. 

6. Will data be transferred internationally?

The processing of Users' data is not subject to international data transfers. Notwithstanding the foregoing, in the event that it is required, the Controller will ensure that such data processing is always protected with appropriate safeguards, which may include:

  • Standard clauses approved by the EU: These are contracts approved by the European legislator, which provide sufficient guarantees to ensure that the processing complies with the requirements established by the GDPR.
  • Third-party certifications: this is the adherence to a standardized framework agreement for data processing that ratifies that the requirements of the European Data Protection Regulation are met.

Notwithstanding the foregoing, the Controller may have service providers located outside the European Economic Area and consequently, the performance of the services may involve international data transfers. In these cases, the Controller will act with due diligence and will apply the content of this Privacy Policy, and other provisions relating to international data transfers provided by the RGPD, the LOPDGDD and other applicable regulations.

7. Is the data subject to profiling and automated decision making?

The processing of data by the Data Controller does not imply that they are subject to automated decision making.

However, the Controller may carry out additional processing involving profiling in order to predict the behavior of Users on the Web, or analyze browsing habits by displaying content on the Web based on the preferences shown by the User during browsing or any other information obtained thanks to cookies.

Likewise, some of the processing related to cookies and possible profiling may be beyond the control of the Controller as a result of the User's browsing on other websites. The Controller, as part of its commitment to privacy, makes available to the User information and proposals for setting cookies in its Cookies Policy.

8. What are the rights related to the data and how can they be exercised? 

The legislation in force grants a series of rights to the Users by reason of the treatment of their data, which we summarize below:

  1. Right of accessThe User shall have the right to know his/her personal data processed by the Controller and the purposes for which such personal data will be used.
  2. Right of rectificationThe User may request the rectification of his/her data at any time.
  3. Right to suppressionThe User may request, at any time, that his or her personal data be deleted from the files of the Controller. However, as indicated in the section on data retention, in certain circumstances, compliance with current legislation may prevent the effective exercise of this right.
  4. Right of opposition: the User may object to the processing of his/her data in relation to any of the purposes for which the Controller processes his/her data, in accordance with the privacy policies applicable in each case. 
  5. Right to limitation of processing: the User will be able to request the limitation of the treatment in the following cases:
    1. If you believe that the data is not correct or accurate;
    2. If you believe that your data is not being processed legitimately, but you would prefer that we limit the processing of your data to its deletion;
    3. If the data is no longer required by us for the purpose for which it was collected, but it is necessary for us to retain it in order to pursue legal claims;
    4. If, having exercised the right to object to any processing, a response is pending from the Controller.

6. Right to data portability: the User shall have the right, where technically feasible and reasonable, to request that personal data provided directly by him/her be communicated to another data controller.

Although the data have been collected by means of the User's consent, the User may revoke it at any time, with no consequences for the User, beyond, depending on the right exercised, not being able to provide certain services.

In Spain, the competent authority is the Spanish Data Protection Agency.
